These Terms and Conditions (Terms) govern your use of the website (https://awschool.com.au/) and services (including the LMS and the Courses) provided by Water Research Australia Limited trading as Australian Water School ABN: 32 127 974 261 (we, us, our) on the website.
By accessing or using the website or services (including the LMS and the Courses) on our website, you agree to comply with and be bound by these Terms.
If you do not agree to these Terms, please refrain from using the website and services (including any Course).
1. Enrolment Agreement
1.1. By enrolling in a course available on the website (Course) (Enrolment), you agree to pay the full amount for the Course (the Course Fees) prior to the first Course session (Course Commencement Date).
1.2. The approximate duration of the Course is provided on the Course page under the heading ‘Format’ (Duration).
1.4. You warrant to us that you have read and understood these Terms prior to Enrolment.
2. Course Enrolment
2.1. Prerequisites for Course entry, where relevant, are outlined under ‘Prerequisites’ on the Course page. You warrant that you are aware of, and have completed, any relevant Course prerequisites, if applicable.
2.2. Each Enrolment is for one (1) attendee only.
2.3. Enrolment is completed once you have been issued a username and password for access to the Learning Management System (LMS) and the Course Fees have been paid in full to us.
2.4. The Course Duration is effective from the date of full payment of the relevant Course Fees, for an on-demand Course (30 days or 90 days for a series), or 30 days after the last live session of a live online Course, as applicable.
2.5. Special offer coupon codes must be applied at checkout and cannot be added retrospectively.
2.6. Course Fees are subject to change at our discretion, and will be effective upon posting of the changes on the Course Page website and LMS.
2.7. Enrolments are non-transferable. However, Course transfers are allowed in certain situations as outlined in the Course Transfer Policy in section 5 below.
2.8. We reserve the right to suspend or terminate your entry or access to a Course if, in our reasonable opinion, you have not complied with these Terms, or otherwise done or not done anything that constitutes inappropriate behaviour, including as set out in the table below. You are not entitled to any refund of the Course Fee in this scenario. Course re-admittance will be at our discretion.

| Spamming or Trolling | Posting repetitive, irrelevant, or disruptive messages in chat or forums. |
| Unauthorized Recording or Distribution | Recording sessions or sharing Course materials without permission. |
| Impersonation or Misrepresentation | Pretending to be another participant or providing false identity information. |
| Disregard for Moderator Instructions | Ignoring repeated warnings or instructions from course moderators. |
| Disruption of Learning Environment | Any behaviour that significantly impairs the learning experience for others. |
3. Course Materials and Access
3.1. Course materials are supplied online, and may be downloaded, unless stated otherwise.
3.2. Course materials, including but not limited to PDF documents, Microsoft Word documents, and software downloads relevant to the enrolled Course, are provided through the LMS. These materials are included in the Course Fees, unless stated otherwise, and are made available for download at any time during the designated Course access period. Access is available 24 hours a day, 7 days a week, except during scheduled system maintenance or unforeseen technical disruptions.
3.3. All Course materials, content, and intellectual property in relation to the website, our services, or otherwise in relation to a Course (including copyright), remain our property and may not be copied, used, distributed, modified, published, or reproduced without our prior written consent.
3.4. Course access is granted for 30 or 45 days for standard Courses (see relevant Course page), 4 months for ‘Series’, and 3 months for bundles, as applicable, from the date of Enrolment. Extensions are available upon request (additional fees may apply at our discretion).
3.5. To access the LMS, you will need a computer with a current operating system, and high-speed internet. Basic computer skills are required.
3.6. Course completion records in the LMS are for internal use only.
4. Course Withdrawal, Refunds, Rescheduling and Cancellations
4.1. Refunds of Course Fees are provided under the following conditions:
(a) A full refund is available if the Enrolment is cancelled by you at least 5 working days before the relevant Course Commencement Date.
(b) No refund of the Course Fees will be provided if cancellation by you occurs within 4 working days from the relevant Course Commencement Date; and
(c) Notwithstanding the above, no refund of the Course Fees will be provided if you cancel the Course and any work or assessments have been saved or submitted in relation to that Course.
4.2. Refund Requests will be assessed on a case-by-case basis at our discretion.
4.3. Course rescheduling or cancellations by us, are subject to the following terms:
(a) We reserve the right to reschedule or cancel a Course due to unforeseen circumstances or other circumstances beyond our control, including any force majeure event, unavailability, or insufficient Enrolment or other operational issues.
(b) If we reschedule or cancel a course before the relevant Course Commencement Date, you will be offered a full refund of the Course Fees or the option to transfer to another Course.
(c) If the Course is rescheduled or cancelled after the relevant Course Commencement Date, we will either offer a partial refund of the Course Fees based on the portion of the Course completed or provide a free extension for Course completion, at the attendee’s preference.
4.4. If you cannot complete a Course, you may request an extension, which is available at our discretion and subject to a small fee. See our Course Extension Policy (5).
5. Course Extension Policy
5.1 Eligibility for Course Extensions
(a) If you are unable to complete a Course within the designated access period (single Course – 30 days; Course Series – 4 months) from the date of Enrolment, extensions will be applied subject to payment of the applicable extension fee.
(b) Details of current extension fees are published in the FAQs on our website.
5.2 Extension Requests and Limits
(a) One extension will be granted per paid extension fee, with the duration of each extension determined in accordance with the extension fee table.
(b) A maximum of two (2) extensions may be granted for each Course or Series Enrolment.
(c) No further extensions will be granted once the maximum number of extensions has been reached.
5.3 Payment and Activation of Extensions
(a) An extension will only be applied once full payment of the applicable extension fee has been received by us.
(b) Upon processing of the extension, you will be notified by email of the revised Course or Series expiration date.
6. Course Transfers
6.1 Course transfers by individual attendees are permitted within 5 days from the course Commencement Date, on request, subject to the below.
6.2. Transfer fees may apply, and the attendee will be required to pay the difference in Course Fees if transferring to a course with a higher Course Fee.
6.3. Course transfers are not permitted once a Course has commenced.
7. Confidentiality and Privacy Policy
7.1. Please see our privacy policy, available at: https://www.waterra.com.au/Web/Web/Privacy-Policy.aspx.
7.2 You must maintain the confidentiality of all of our confidential information, including Course content, documents and materials, and any other information of a confidential, proprietary, commercial or sensitive nature that you are provided with or access via the website, the LMS, or the Courses (including any login information or other of our intellectual property) (Confidential Information).
7.3 You must only use and disclose Confidential Information to the extent necessary to use the website, LMS, or participate in the Courses. You must not otherwise use or disclose any Confidential Information without our prior written consent.
7.4 You must immediately notify us of any suspected or actual unauthorised use or disclosure of Confidential Information.
8. Third-Party Authorisation
8.1. If you require a third party to access your Course information, you must provide a signed written authorisation with the following details:
(a) Your full name, contact information, and Course title.
(b) The third party’s full name, relationship to you, and identification details.
8.2. For employer enrolments, we may share your progress, results, and other information in relation to your Course participation as required by your employer.
9. Intellectual Property
9.1. Intellectual Property means all intellectual property rights of any type or nature whatsoever, and in any jurisdiction, involved in or associated with or in relation to the website, the LMS, our services, or the Courses, including but not limited to Course content, documents and materials, and other resources, including copyright, trade marks, designs, know how, and any other registered or unregistered intellectual property rights (Intellectual Property). All Intellectual Property remains our sole property.
9.2. The attendee must:
(a) at all times keep all Intellectual Property private and confidential; and
(b) use the Intellectual Property solely for the purpose of completing the Course.
9.3 The attendee must not:
(a) assert any ownership or other interest in or to or exploit, modify or develop any of the Intellectual Property;
(b) copy or reproduce the Intellectual Property without our prior written consent;
(c) share or make the Intellectual Property available to or accessible by any third party; or
(d) do anything that will or may damage, jeopardise the ownership of or bring into disrepute or question.
9.4 You must immediately notify us of any suspected or actual unauthorised use or disclosure of our Intellectual Property.
9.5 You warrant that you have the right (including with any third party consents) to provide us with any content, information, materials, or other intellectual property provided by you via the website, the LMS, or in relation to a Course.
10. Your access and the website, including suspension and termination
10.1. Without limiting these Terms, we reserve the right to:
(a) suspend or terminate your access to the website, the LMS our services, the Courses, or your account; and/or
(b) edit or remove any material that you have may have uploaded, posted, emailed or otherwise transmitted,
at our discretion, on prior notice, if we have reasonable grounds to believe that you have committed a breach of these Terms. We may reinstate such access at our discretion.
11. Links to Third-Party Websites
11.1. Our website may contain links to third-party sites. We are not responsible for the content or practices of these external sites, and we recommend reviewing their terms and conditions.
12. Modifications
12.1. Australian Water School reserves the right to update or modify these Terms at any time. We will notify you of any such changes. By continuing to the website, our services, or participation in a Course, you will be deemed to agree to the changes. We recommend reviewing these Terms periodically to stay informed.
13. Plagiarism
13.1 Plagiarism is not tolerated. Attendees must ensure that all work or other content or material submitted is their own work, written in their own words. If we reasonably believe that any work submitted by the attendee is plagiarised (including being not completed solely by the attendee (including via any artificial intelligence)), we reserve the right to:
(a) require the attendee to re-submit the relevant work in their own words; or
(b) if the plagiarism is excessive or repeated, suspend or terminate the attendee’s Enrolment.
14. Content and website issues
14.1. While we take all reasonable steps to ensure the accuracy of the information provided on our website and within Course materials, we do not warrant or guarantee that all content or materials are error-free, complete, or up-to-date. We also do not warrant or guarantee that the website, the LMS, or any information available via the website or LMS, or your use of such things, are free from errors, interruptions, delays, viruses, corruption, bugs, or other harmful or malicious software or code.
13.2. We reserve the right to make changes to Course details, content, and materials at any time without notice.
13.3. To the extent permitted by law, we are not liable for any liability, loss or damage that you may incur or suffer arising due to the inaccuracy, incompleteness, or outdated nature of any information on our Website, LMS, or Course materials, or otherwise from use of the website or LMS.
15. Limitation of Liability and indemnity
15.1. To the extent permitted by law, we are not liable for any consequential, indirect, incidental, special, or other consequential damages arising from your use of our website, the LMS, our services, or the Courses, or otherwise arising under these Terms, including loss of data, computer failure or malfunction, loss of revenue or profit, loss of opportunity, loss of reputation, loss of business, or loss of goodwill.
15.2 To the extent permitted by law, we exclude all representations, guarantees, and warranties, express or implied, other than those contained in these Terms. Where we are liable for breach of any representations, guarantees, and warranties implied by statute and which we cannot lawfully exclude, our liability is limited (to the extent permitted by law) at our option to either:
(a) in the case of goods supplied or offered by us, to the supply of those goods again or to the payment of the cost of having those goods supplied again; or
(b) in the case of services supplied or offered by us, to the supply of the services again or to the payment of the cost of having services supplied again.
15.3 Notwithstanding any other clause, to the extent permitted by law, our aggregate maximum liability to you arising out of or in relation to these Terms, your use of our website, the LMS, our services, or the Courses (whether under contract, tort, statute, equity, or under any indemnity) is limited to the Course Fees paid by you.
15.4 You agree to indemnify us, and pay us within 5 working days of demand, for any liability, loss or damage we incur or suffer in relation to your breach of these Terms, or other loss or damage to property (including to data, systems, or intangible property), or other personal injury, illness or death to the extent caused by you, including your breach of these Terms or negligence. This indemnity is to be reduced proportionately to the extent caused by our breach of these Terms or negligence.
16. Force Majeure
16.1. We will not be liable for any failure or delay to fulfill our obligations under these Terms if such failure is caused by circumstances beyond our control, including but not limited to natural disasters, acts of god or terrorism, or technological failures.
16.2. In the event of a Force Majeure occurrence, we will make reasonable efforts to resume the affected obligations as soon as possible.
17. Dispute Resolution
17.1. In the event of any dispute arising from or in connection with these Terms, we encourage attendees to contact us directly to resolve the issue amicably.
17.2 Any complaints must be made in writing and submitted to training@awschool.com.au.
17.3 We will endeavour to respond to and resolve any complaint with 10 working days.
18. Your use
18.1 You must not:
(a) use the website, the LMS, or the Courses in a manner that:
- is contrary to any law or which may encourage a person to act in a way which is contrary to any law;
- may result in loss or damage;
- is disruptive to the learning of others or that may restrict, disrupt or inhibit any other user;
- endangers the health or safety of any person; or
- may cause an interference to any business conducted by us;
(b) upload, post, email or otherwise transmit any of the following to, or through, the website or LMS:
- confidential material;
- misleading or deceptive material;
- advertising, marketing or promotional material;
- material which you do not have a right to upload, post, email or otherwise transmit, such as material which is protected by copyright, patent, trade mark, service mark, or any other proprietary right, without first obtaining express permission from the owner of the material or relevant right holder and providing with the material appropriate acknowledgement of existence of the right and the permission of the right holder; or
- material which contains a virus, or other harmful or potentially harmful code;
(c) download or reproduce any material which you know, or reasonably ought to know, is of a kind described in paragraph (g) above except as permitted by law;
(d) alter, damage or delete any material of which you are not the author, unless you have express permission from the author;
(e) impersonate any person or entity;
(f) collect or store personal information about other users in a manner which is inconsistent with these Terms or our privacy policy.
18.2 You must comply with any lawful instruction of ours in your use of the website, LMS, or Courses.
18.3 If you breach any of the Terms, we may undertake our own investigations and may also inform relevant law enforcement agencies and providers of educational and information services of such conduct.
